These Terms of Service ("Terms") govern your use of the Arc mobile application ("App") provided by EmoryJoule ("we," "our," or "us"). By downloading or using Arc, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
You must be at least 13 years of age to use Arc. By using the App, you represent and warrant that you meet this requirement. If you are between 13 and 18 years old, you represent that you have your parent or guardian's permission to use the App.
To use Arc, you must create an account using a valid email address or Sign in with Apple. You are responsible for:

You agree to use Arc only for lawful purposes and in a manner consistent with these Terms. You agree not to:
Arc is a fitness tracking tool, not a medical device or healthcare service. The information provided in the App — including workout logs, nutrition tracking, crew scores, Daily Brief summaries, and AI-generated content — is for informational and motivational purposes only.
Arc is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider before starting a new fitness or nutrition program, or with any questions you may have regarding a medical condition.
We are not responsible for any injury, illness, or other adverse outcome resulting from your use of the App or reliance on its content.
You retain ownership of the content you create in Arc (workout logs, messages, photos, etc.). By using the App, you grant EmoryJoule a limited, non-exclusive license to store and transmit your content solely as necessary to provide the App's features.
Arc's crew features (groups, circles, chat) are designed to support positive accountability relationships. You are solely responsible for your interactions with other users. We reserve the right to remove users who engage in abusive, harassing, or otherwise unacceptable behavior.
We do not actively monitor private crew messages but reserve the right to investigate and take action on reports of abuse or violations of these Terms.
Arc and all of its content, features, and functionality — including the design, graphics, logos, and software — are owned by EmoryJoule and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
Arc integrates with third-party services including Apple HealthKit, Supabase, and Anthropic. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.
The App is available through the Apple App Store. Your use of the App Store is subject to Apple's Terms and Conditions. Apple is not responsible for Arc or its content.
We strive to keep Arc available and working, but we do not guarantee uninterrupted or error-free operation. We may:
We are not liable for any loss or damage resulting from downtime or changes to the App.
We may suspend or terminate your access to Arc at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to other users or our services.
You may stop using the App at any time. To delete your account, email support@runarc.app.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, EJORYJOULE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $100 IF YOU HAVE NOT MADE ANY PAYMENTS).
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction in the United States.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the new Terms.
