These Terms of Service ("Terms") govern your use of the Arc mobile application ("App") provided by EmoryJoule LLC ("EmoryJoule," "we," "our," or "us"), a company based in Atlanta, Georgia, USA. By downloading or using Arc, you agree to be bound by these Terms.
If you do not agree to these Terms, do not download or use the App.
Arc is a personal data logging and social accountability app. It is not a medical device, clinical tool, healthcare service, or substitute for professional medical advice, diagnosis, or treatment of any kind.
EmoryJoule is a software company — not a healthcare provider, medical practice, or licensed health professional. Arc does not employ physicians, dietitians, certified trainers, therapists, or any other licensed health professionals in connection with the services provided through the App.
Everything Arc displays — including workout logs, nutrition totals, macro estimates, water intake, weight trends, sleep summaries, heart rate data, HRV readings, mood entries, AI-generated Daily Brief summaries, food scan estimates, crew scores, correlations, and any other data output — is provided for general informational and motivational purposes only. Always seek the advice of your physician or other qualified health provider before starting a new fitness program, making changes to your diet, or with any questions you may have about a medical condition. Never disregard professional medical advice or delay seeking it because of something you read or see in Arc.
If you are experiencing a medical emergency, call 911 or your local emergency services immediately. Arc is not designed for and must not be used in emergency situations.
Arc uses artificial intelligence (the Anthropic Claude API) to generate certain content, including Daily Brief summaries, food macro estimates from photos, and potential data correlations. You acknowledge and agree that:
You must be at least 13 years of age to use Arc. By using the App, you represent and warrant that you meet this requirement. If you are between 13 and 18 years old, you represent that you have your parent or guardian's permission to use the App.
If you have any medical condition, injury, or health concern, consult with a qualified healthcare professional before using Arc to track fitness or nutrition data. Arc is not designed for use by individuals under medical supervision for specific health conditions without the guidance of their healthcare provider.
To use Arc, you must create an account using a valid email address or Sign in with Apple. You are responsible for:
You may not create an account on behalf of another person without their permission, or use someone else's account.
You agree to use Arc only for lawful purposes and in a manner consistent with these Terms. You agree not to:
You retain ownership of the content you create in Arc (workout logs, messages, photos, etc.). By using the App, you grant EmoryJoule a limited, non-exclusive license to store and transmit your content solely as necessary to provide the App's features. We do not claim ownership of your personal data.
Arc's crew features are designed to support positive accountability relationships. You are solely responsible for your interactions with other users. We reserve the right to remove users who engage in abusive, harassing, or otherwise unacceptable behavior, at our sole discretion.
We do not actively monitor private crew messages but reserve the right to investigate and take action on reports of abuse or violations of these Terms.
When you choose to share data with your crew (workout logs, nutrition, scores), you do so voluntarily. EmoryJoule is not responsible for how other users interpret, discuss, or react to the data you choose to share. Do not interpret feedback from crew members as medical or professional advice.
Arc and all of its content, features, and functionality — including the design, graphics, logos, and software — are owned by EmoryJoule and are protected by copyright, trademark, and other applicable intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
Arc integrates with third-party services including Apple HealthKit, Supabase, and Anthropic. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices, accuracy, or reliability of third-party services.
The App is available through the Apple App Store. Your use of the App Store is subject to Apple's Terms and Conditions. Apple is not a party to these Terms and is not responsible for Arc or its content.
We strive to keep Arc available and working, but we do not guarantee uninterrupted, error-free, or continuous operation. We may:
We are not liable for any loss or damage resulting from downtime, changes to the App, or unavailability of any feature.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA OR CONTENT.
EMORYJOULE EXPRESSLY DISCLAIMS ALL LIABILITY FOR:
YOU EXPRESSLY ACKNOWLEDGE THAT YOUR USE OF ARC IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EMORYJOULE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless EmoryJoule LLC and its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of or reliance on the App; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit, post, or transmit through the App.
We may suspend or terminate your access to Arc at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to other users or our services. Upon termination, your right to use the App ceases immediately.
You may stop using the App at any time. To delete your account, email support@runarc.app.
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. You agree that any dispute arising under or relating to these Terms or the App shall be resolved exclusively through binding individual arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction in Atlanta, Georgia for matters that cannot adequately be addressed through arbitration.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, stop using the App and delete your account.
